Can a minor who received deferred adjudication for an MIP get his record expunged under 106.12 of the Alcoholic Beverage Code (a cheaper version), or must he use 55.02 (the more expensive expunction)?

A successfully completed deferred is expungable under 45.051, conviction under 106.12 when 21, assuming not more than one conviction. This would permit an expunction of conviction of class A furnishing alcohol to minor. so is a conviction for FATM better than a deferred for a D under 21 with no TABC Ch106 priors? TABC 106.12: Any person convicted of not more than one violation of this code while a minor, on attaining the age of 21 years, may apply to the court in which he was convicted to have the conviction expunged.
