Erase A Texas Criminal Record

There's no need to go through life dragging a criminal record behind you like a heavy piece of unwanted baggage when you can get it erased! Why should childhood antics or grown-up peccadilloes continue to weigh against you for years on end?

We all make mistakes -- and one of the biggest mistakes those with criminal records can ever make is disregarding the information set forth in this website on how to get it erased. Texas law allows you to erase your criminal record by withdrawing your plea and having the case dismissed, under most cases.

The law is somewhat complex in certain areas, but erasing of a criminal record is something that SHOULD be done by anyone who qualifies, with even a minor history of arrest or conviction. Contrary to popular belief, records are not cleared automatically with the passing of time, but require the filing of a Petition in Court.

To erase your Texas criminal record, it may take from many months to almost a year depending upon the Court and the severity of the case. The fees are reasonable, and include research, filing fees, the drafting of the Petition, and any Attorney in Court hearings.

Post Conviction Relief

A way of avoiding deportation of a criminal conviction is to return to criminal court to “vacate” the conviction. This is known as seeking “post conviction relief.” Any person convicted of a crime may, pursuant to post conviction relief, will file a petition for post-conviction relief captioned in the action in which the conviction was entered.

A petition for post-conviction relief is cognizable if based upon any of the following grounds:

(a) Substantial denial in the conviction proceedings of defendant's rights under the Constitution of the United States or the Constitution or laws of your own State;

(b) Lack of jurisdiction of the court to impose the judgment rendered upon defendant's conviction;

(c) Imposition of sentence in excess of or otherwise not in accordance with the sentence authorized by law.
